1. Introduction

Welcome to Kwikkit. These Terms and Conditions ("Terms") govern your access and use of our platform and services. Please read these Terms of Use carefully before using our services. By installing, downloading, or using the Platform, you agree to be bound by these Terms and all related Kwikkit policies. If you do not agree, please do not use the services and uninstall the app. Your use constitutes a legal agreement with Kwikkit, effective from the date of installation or use.

To use the Services, you must agree to these Terms by either clicking "Accept" when prompted or by using the Services. Your use of the Services will be considered acceptance of the Terms from that point forward.

2. Definitions

"Platform" means the website and mobile application operated by aushadhiya foods private limited.

"User" or “Customer” means any person accessing or using the Platform.

"Restaurant Partners" are registered restaurants providing food listed on the Platform.

"Delivery Partners" are third-party logistics providers facilitating delivery.

"Services" means, including but not limited to, the online food ordering and delivery services provided.

3. Eligibility

You confirm that you are at least 18 years old and fully capable of understanding and agreeing to these Terms. You also agree to comply with all applicable laws while using the Services and to use the Services lawfully, respecting the legal rights of Kwikkit and others.

You must provide accurate registration details and be legally capable of entering into binding contracts. Use of services implies acceptance of these Terms.

Kwikkit may revise these Terms at its sole discretion. It is your responsibility to review the Terms periodically and comply with any updates. Continued use of the Kwikkit Platform after changes constitutes your acceptance of the revised Terms.

Kwikkit may offer translations of these Terms in various languages for your ease of understanding. However, please note that the English version is the official and binding text governing your agreement with Kwikkit. If there is any discrepancy between the English and translated versions, the English Terms will always take priority.

4. Use of the Platform

The Platform enables Users to order food from Restaurant Partners.

The Platform acts only as an intermediary and does not prepare, sell, or distribute food.

Restaurant Partners and Delivery Partners are independent entities; Kwikkit is not responsible for their acts or omissions.

Our software or the app store providing the software may include features to automatically check for updates or upgrades. Unless your device settings prevent it, updates may be pushed to your device automatically, and you may need to install certain updates to continue using the Services. These updates are considered part of the Services.

You may delete your account at any time by contacting us via the "Contact Us" link found at the bottom of every page, or by following this process: Go to Profile > Settings > Account Control > click on the 'Delete Account' button and discontinue further use of the Services.

We reserve the right to terminate your access to the Services and deny you further use at our sole discretion, for any reason or no reason at all, including but not limited to your violation of these Terms or prolonged inactivity. Termination may occur without prior notice, and we may immediately deactivate or delete your account and all associated information, blocking any further access to your account or the Services.

If you use the Services in violation of these Terms, we may retain any data collected from your account at our discretion. You agree that we shall not be liable to you or any third party for suspending or terminating your access to the Services.

While there is currently no fixed limit on the number of transmissions you can send or receive via the Services, Kwikkit may set such limits at its discretion in the future.

To enhance your experience, we regularly conduct research and experiments on various features across our platform and services. This means some users may see features differently at times as we work to improve usability, safety, and add new offerings.

Kwikkit is constantly evolving to offer the best possible experience and information to its customers. You acknowledge and agree that, to facilitate this, Kwikkit reserves the right to suspend, cancel, or discontinue any or all of its products or services at any time without prior notice. Additionally, Kwikkit may modify, update, or change any content, products, or services available on the platform, also without notice.

Any certifications, licenses, or permits ("Certifications") displayed on a Restaurant’s listing page on the Kwikkit Platform are provided for informational purposes only. These Certifications are shown based on the information supplied by the Restaurant partners or Merchants and are presented on an "as available" basis. Kwikkit does not guarantee the validity, authenticity, accuracy, or reliability of these Certifications or related information. Customers relying on such Certifications do so at their own risk. Kwikkit accepts no liability for any loss or damage resulting from the use of this information, discrepancies in Certification, or any non-compliance of applicable laws by the Restaurant or Merchant.

Kwikkit reserves the right to charge a subscription and/or membership fee in respect of any of its product or service, fee for providing Platform Services (as defined below) to Customer(s) and/or any other charge or fee on a per order level from Customers, in respect of any of its product or service on the Kwikkit Platform anytime in future. ‘Platform Services’ entails usage of the Kwikkit Platform by the Customer(s) which, inter alia involves access to menus of various Restaurants listed on the Kwikkit Platform, facilitating order placement with the Restaurants, facilitating delivery of the food ordered from Restaurants, live tracking of orders on the Kwikkit Platform, customer support in case of any concerns with respect to the orders placed through the Kwikkit Platform.

Kwikkit may from time to time introduce referral and/or incentive based programs for its Customers (Program). These Program(s) may be governed by their respective terms and conditions. By participating in the Program, Customers are bound by the Program terms and conditions as well as the Kwikkit Platform terms. Further, Kwikkit reserves the right to terminate / suspend the Customer's account and/or credits / points earned and/or participation of the Customer in the Program if Kwikkit determines in its sole discretion that the Customer has violated the rules of the Program and/or has been involved in activities that are in contravention of the Program terms and/or Kwikkit Platform terms or has engaged in activities which are fraudulent / unlawful in nature. Furthermore, Kwikkit reserves the right to modify, cancel and discontinue its Program without notice to the Customer.

Kwikkit may from time to time offer to the Customers credits, promo codes, vouchers or any other form of cashback that Kwikkit may decide at its discretion. Kwikkit reserves the right to modify, convert, cancel and/or discontinue such credits, promo codes or vouchers, as it may deem fit.

5. Content

We exclusively own all copyrights to the Services and the Content we provide. This includes all associated intellectual property rights ("IP Rights") such as trademarks, service marks, logos, trade names, trade dress, and other proprietary rights worldwide. These may be protected under various laws including copyright, patent, and trademark regulations. You acknowledge that the Services include original works created and organized by us and our partners after significant time, effort, and investment, representing valuable intellectual property.

Additionally, some information within the Services may be confidential and you agree not to disclose it without our written permission.

You commit to protecting Kwikkit's proprietary rights and those of our partners during and after your use of the Services, complying with reasonable requests we or our licensors make to safeguard these rights. You recognize that Kwikkit (and our licensors) hold all legal ownership in the Services and IP Rights, whether registered or not, regardless of location.

You also agree not to use any of Kwikkit's trademarks, logos, or proprietary information without permission. This includes refraining from framing our marks, removing copyright notices, or altering any proprietary identifiers.

6. Orders & Payment

Prices and availability are as listed by Restaurant Partners and subject to change. All prices listed on the Kwikkit Platform are furnished by the Restaurant Partner, including any packaging or handling charges at the time of listing. Kwikkit displays these prices as received but does not guarantee their accuracy or timeliness. Please note that the final price charged to you by the Restaurant Partner, including packaging and handling, may differ at delivery. In case of any discrepancy between the price on the Kwikkit Platform and the price charged by the Restaurant Partner, the latter will be considered accurate, except for Kwikkit's delivery charge.

The final payable amount including taxes and delivery charges will be shown before order confirmation. Payment must be completed online before delivery.

Refunds and cancellations are subject to the Platform’s refund policy.

7. Delivery

Delivery is facilitated either by Restaurant Partners or third-party Delivery Partners.

The Platform is not liable for delivery delays, damages, or incorrect orders.

Delivery Partners may contact you directly for delivery coordination.

You may be charged a delivery fee for your order, determined by the Delivery Partner, Restaurant Partner, or Store (“Delivery Charges”). You agree that Kwikkit is authorized to collect these Delivery Charges on behalf of the respective party. Delivery Charges may vary depending on factors such as the Restaurant Partner or Store, order value, distance, and time of day. Kwikkit will inform you of any Delivery Charges applicable, but you remain responsible for any Delivery Charges incurred, whether or not you are aware of them.

In addition to Delivery Charges, you may also be charged a delivery surge fee (“Delivery Surge”) based on factors like distance, time taken, demand, traffic, weather, and peak periods. Kwikkit is authorized to collect Delivery Surge fees on behalf of the Delivery Partner, Restaurant Partner, or Store. Delivery Surge fees may vary per order and Kwikkit will make reasonable efforts to notify you, but you remain responsible for any Delivery Surge fees incurred regardless of notification.

For each order you place, Kwikkit will issue relevant documents such as order summaries and tax invoices as required by law and common business practices.

8. User Responsibilities

Provide accurate delivery information and ensure someone is available to receive the order.

Do not resell food ordered via the Platform.

Use the Platform lawfully and do not misuse services or accounts.

9. Restaurant Partner Obligations

Must comply with all applicable laws including food safety and plastic usage regulations.

Cannot contact Users directly or demand payments outside the Platform.

10. Privacy
Your data will be handled as per our “Privacy Policy” which you agree to by using the services. It is your responsibility to be fully aware of the Privacy Policy and any updates/modifications made to it thereby. 

11. Dispute Resolution

Grievances can be addressed to the customer support team via provided contact details. These Terms are governed by Indian law, and disputes are subject to the jurisdiction of courts in Haryana.

12. Limitation of Liability

The Platform disclaims all liability for loss or damage arising from use of services, except as mandated by law.

Liability for personal injury or death caused due to negligence will not be excluded.

13. Severability
If any provision is found invalid or unenforceable, remaining provisions will continue in effect.
